Conditions of use By using this website, our social media page, and program services you certify that you have read and reviewed this Agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this Agreement, you are advised to leave the website and refrain from program participation accordingly.

[Rescues ON85th only grants use and access to this website, its products, and its services to those who have accepted its terms.

Privacy policy Before you continue using our website, we advise you to read our privacy policy regarding our user data collection. It will help you better understand our practices.

Age restriction You must be at least 18 (eighteen) years of age before you can use this website or apply for services. By using this website or obtaining services from any of our programs, you warrant that you are at least 18 years of age and you may legally adhere to this Agreement. Rescues ON85th assumes no responsibility for liabilities related to age misrepresentation.

You agree that all materials, products, and services provided to you are as is and acceptance as such are on a first come first served basis except for homeless elderly, and veteran applicants and/or participants.

 You also agree that you will not reproduce or redistribute, sell, or barter Rescues On85th’s intellectual property or products in any way,  You grant Rescues On85th a royalty-free and non-exclusive license to display, use, copy, transmit, and broadcast the content you upload and publish any pictures taken on distribution locations or other events.

User accounts

As a user of this website and program account services, you may be asked to register with us and provide private information. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your account or password. If you think there are any possible issues regarding the security of your account on the website, inform us immediately so we may address them accordingly.

We reserve all rights to terminate accounts, edit or remove content and cancel orders at their sole discretion.

Indemnification You agree to indemnify Rescues ON85th and its affiliates and hold Rescues ON85th harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.

Limitation on liability. Rescues ON85th  is not liable for any damages that may occur to you as a result of your misuse of our website. Rescues ON85th reserves the right to edit, modify, and change this Agreement at any time. We shall let our users know of these changes through electronic mail. This Agreement is an understanding between Rescues ON85th and the user, and this supersedes and replaces all prior agreements regarding the use of this website. In addition:
1.  Only (1) one account per household having cat(s) or dog(s) residing at their residency. This includes multiple cats and/or dogs.
2). The applicant and/or participant must have legal ownership of the cat(s) or dog(s) residing at their residency;
3). Identification on the application on file must be a valid identification of a state Alabama license or State identification Card. If such identification is not available, a referral letter signed by a social service agency is acceptable on letterhead. Acceptance is at the Executive Directors' approval.
4). Participant(s) may not sell or trade dog and/or cat food, supplies, or any other products provided.
5). Participants may not use two (2) different names on applications, this constitutes fraud and an immediate ban from the program. Just to let you know, a notice will be sent to such individuals committing such an act.;
6). All applications must be completed correctly and boxes checked before the issue of any products.
7). Products may not be shared or disbursed to other households.
8). Extra products will not be disbursed due to the issue of reloading and wait times. This service is meant to help you not replace your responsibility as a provider to your Cat(s) or Dog(s).
9). All Applicant(s) and/or Participant(s) must provide additional verification of income such as a WIC, Medicare/Medicaid, Unemployment document, or homeless statement from social services.
10). After (3) Three distributions of products, the participant must provide documentation that the Cat(s) or Dog(s) have been Spayed or Neutered to continue assistance for (3) additional months.
(11). Participants and applicants shall be barred from the Nutrition One program if they have collaborated with individuals to reapply for services under another name or a fictitious name to obtain products.
12). Breeders may not receive services under any conditions.
13). Any violent actions (physical and/or verbal) toward staff or volunteers shall be immediately and permanently banned from all programs and services, and law enforcement shall be disbursed to that party initiating such action.
14) If violent actions result in harm or feeling of such endangerment by staff, volunteers, applicants, or participants, such services will be discontinued, and relocation shall be established.
15) Staff, volunteers, or partnering agencies shall not benefit from the services or products received under or through RESCUES ON85TH or any of its programs.
16). When TRN Captains have been established, no more than four boxes per household shall be provided dependent on the number of animals served.
RESCUES ON85TH reserves the right to add to or change this policy as it sees fit to protect the program, its staff, volunteers, partner agencies, etc.
 

WAIVER

In order to engage in any activity or receive assistance each applicant must be at least the age of eighteen (18) and must read and agree to this Assumption of Risk, Release, Hold Harmless & Waiver of Liability, and Permission of Photo Use Form.  A Parent or Guardian must apply to receive assistance if the applicant is under the age of 18.​

By utilizing our service, you have agreed and accepted the terms of receiving assistance and/or participating in the activities to which you have applied through ON85th. We do not guarantee the quality or similar services provided are equal to that of other service providers.
