Waiver of Liability

I, agree and acknowledge to the following terms as a participant in the RESCUES ON85TH Spay & Neuter Program:

1. Voluntary Participation: I understand that participation in this program is voluntary and that RESCUES ON85TH, in collaboration with Alabama Spay & Neuter Clinic and other participating partners, assists with the cost of spay/neuter services for my cat(s) and/or dog(s).

2. Third-Party Services & Assumption of Risk: I acknowledge that spay/neuter procedures will be performed by licensed veterinarians at Alabama Spay & Neuter Clinic or another designated provider. I understand that RESCUES ON85TH is solely a facilitator of payment and has no control over the medical treatment or procedures performed by these third-party providers. I accept that all medical procedures carry inherent risks, including but not limited to infection, anesthesia complications, or unforeseen medical conditions.

3. Veterinary & Partner Responsibility: I acknowledge that the Alabama Spay & Neuter Clinic (or any third-party service provider) is solely responsible for the care, treatment, and safety of my animal(s) during the spay/neuter procedure. RESCUES ON85TH and any associated partners (including referral organizations, transport services, or funding sources) cannot be held liable for any actions, errors, medical complications, or outcomes resulting from veterinary care.

4. Hold Harmless Agreement: I release and hold harmless RESCUES ON85TH, its staff, volunteers, donors, sponsors, and affiliated partners—including but not limited to Alabama Spay & Neuter Clinic, transportation services, financial supporters, and referring agencies—from any and all claims, damages, liabilities, or legal actions arising from or related to my participation in this program. This includes, but is not limited to, complications from the spay/neuter procedure, post-surgical complications, miscommunication, or delays.

5. Appointment & Payment Policy: I understand that I must schedule my spay/neuter appointment directly with Alabama Spay & Neuter Clinic once my application has been approved. I acknowledge that my name will be placed on a list with the clinic for payments made by RESCUES ON85TH. If my application is not approved, I understand that no payment will be made on my behalf, and I will be responsible for covering the cost of the procedure independently.

6. Mandatory Photo Confirmation: I agree to provide a post-surgery photograph of myself holding my cat(s) and/or dog(s) with a visible sign stating: "We got spayed/neutered with RESCUES ON85TH." I understand this is required for program participation and future funding purposes.

7. No Refunds or Reimbursements: I understand that once payment has been made to Alabama Spay & Neuter Clinic or any third-party service provider on my behalf, no refunds, reimbursements, or transfers will be granted under any circumstances.

8. No Guarantees: While spay/neuter procedures are routine and generally safe, I understand that RESCUES ON85TH and its partners cannot guarantee any specific outcome or prevent post-surgical complications. I accept full responsibility for any additional medical care my animal(s) may require after surgery.

9. Agreement to Terms: By signing below, I acknowledge that I have read, understood, and agreed to the terms outlined in this Waiver of Liability. I confirm that I am the legal guardian of the animal(s) listed in my application and that I voluntarily consent to their participation in the RESCUES ON85TH Spay & Neuter Program.
